So You Need Help With The Bill Collectors
You need to understand the law that protects you from illegal practices. Read up on the Fair Debt Collection Practices Act. The law states that a bill collector cannot call you before 8am and after 8pm nationwide. That means if the bill collector is calling from another time zone they have to be aware of where they are calling and what time it is.
A lot of people have cell phones now. There are new laws regarding cell phones. A collector cannot call you on a cell phone if they know it's your cell phone. It costs you money when you use your cell phone, usually by the minute. The law states a collection agency may not create a debt in order to pay a debt.
Laws are changing everyday and most of the time they are in favor of the consumer. The problem is, many consumers don't know the laws. Laws are generally worded and formatted for attorneys so many people have a hard time even reading the laws.
There are several other laws to protect you from harrassing actions of collection agencies. It's thought that a debt expires after 7 years. In some states that is true and in others it is not, you need to know what the statute of limitations is in your own state. In Michigan it's only 6 years, isn't that good to know? You also need to know there are different statute of limitations for different types of debt. For example in Michigan on a civil judgement the statute is 10 years. If your debt is past the statute of limitations then you don't have to pay it and you can tell the collector they have to stop harassing you. They measure your statute of limitations from the last payment you made on the debt.
If a collector continues to call you when you have told them to stop it's harrassment and you can sue them and the agency. Collectors are taught this and know this so if they violate the law then they have to pay up.
You have no obligation to speak to a collection agency. You don't owe them the money, you owed the creditor that sent the bill to them. Some agencies even buy the debt which means the collection agency owns your debt. If that is the case, it also means the agency paid pennies for your debt. So then how is it fair for you to pay them $2000 if they only paid your creditor $20 to buy your debt?
I found a great book online "The Top 10 Secrets Bill Collectors Don't Want You To Know". It's only $1.99 and has a wealth of information. The book is worth it's weight in gold.
